Agreement to Terms
By accessing or using HiringHumans (“the Service”), you agree to be bound by these terms. If you don't agree, please don't use the Service.
If you're using the Service on behalf of a business, you represent that you have the authority to bind that business to these terms.
Description of Service
HiringHumans is a hiring platform for small businesses. We provide tools to create career pages, write and publish job posts, screen candidates through video and written responses, and manage hiring pipelines.
The Service is currently available as a pilot program. Features, availability, and pricing may change as we develop the platform.
Account Responsibilities
When you create an account, you agree to:
- Provide accurate and complete information
- Keep your login credentials secure and not share them
- Notify us promptly if you suspect unauthorized access to your account
- Be responsible for all activity that occurs under your account
We may suspend or close accounts that violate these terms or that we reasonably believe are being misused.
Acceptable Use
You agree not to use the Service to:
- Post job listings that discriminate based on race, gender, age, disability, religion, sexual orientation, or any other protected characteristic
- Create fake, misleading, or fraudulent job listings
- Harass, threaten, or abuse candidates or other users
- Collect candidate information for purposes unrelated to hiring
- Violate any applicable employment laws or regulations
- Attempt to access other users' accounts or data without authorization
- Use the platform to distribute malware or conduct phishing
We take these seriously. Violations may result in immediate account termination.
AI-Generated Content
The Service uses AI to help draft job descriptions and summarize candidate applications. Here's what you should know:
- Review everything. AI-generated content is a starting point, not a final product. You are responsible for reviewing, editing, and approving all content before it's published or acted upon.
- Not professional advice. AI-generated job descriptions are not legal, HR, or compliance advice. Consult qualified professionals for guidance on employment law and best practices.
- No guarantees of accuracy. AI can produce content that is inaccurate, incomplete, or inappropriate. We do our best to make it useful, but we can't guarantee it will be perfect.
- You own the output. Once you edit and publish AI-generated content, it becomes your content and you're responsible for it.
Content Ownership
Your content is yours. You retain ownership of all content you create or upload to the Service — job posts, career page content, business information, and any other materials.
By using the Service, you grant us a limited license to host, display, and distribute your content as needed to operate the platform. For example, we need to display your career page publicly and show your job posts to candidates.
Candidate data belongs to candidates. Application materials, video recordings, and screener responses are provided by candidates. Businesses may access this data for hiring purposes only, as described in our Privacy Policy.
Candidate Data Responsibilities
If you're a business using the Service to collect and review candidate information, you agree to:
- Use candidate data only for evaluating their application for the specific role they applied to
- Comply with all applicable employment and data protection laws
- Not share candidate video or audio recordings outside of your hiring team without the candidate's consent
- Not use candidate information for marketing, sales, or any purpose unrelated to hiring
- Handle all candidate data with reasonable care and security
Payment Terms
HiringHumans is currently free to use during our pilot period. When we introduce paid plans, we'll give you advance notice and clearly communicate pricing before any charges apply.
Limitation of Liability
The Service is provided “as is” without warranties of any kind, either express or implied.
To the maximum extent permitted by law, HiringHumans shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities.
We are not responsible for hiring decisions made using the platform. All employment decisions are made by the businesses using the Service, and those businesses bear full responsibility for their hiring practices.
Our total liability for any claim arising from your use of the Service shall not exceed the amount you paid us in the 12 months preceding the claim, or $100, whichever is greater.
Termination
You can close your account at any time by contacting us. We may also suspend or terminate your access if you violate these terms.
When an account is closed, we will retain candidate application data for one year after the associated job posting closes, as required for employment record-keeping. Business account data will be deleted within 30 days, except where retention is required by law.
Governing Law
These terms are governed by and construed in accordance with the laws of the State of Michigan, without regard to conflict of law principles. Any disputes arising from these terms or the Service shall be resolved in the courts of the State of Michigan.
Changes to These Terms
We may update these terms from time to time. If we make significant changes, we'll notify you by email or by posting a notice on the platform at least 30 days before the changes take effect.
Continued use of the Service after changes take effect means you accept the updated terms.
